Welcome to Driftstack. The ensuing Terms of Service (“Agreement”) constitute a legally binding agreement between you (“User” or “you”) and Driftstack (“we”, “us”, or “our”), governing your use of the Driftstack services, including but not limited to all features, functionalities, user interfaces, and all content and software associated with our service. This Agreement includes our privacy practices as outlined in our Privacy Policy.

1. User Accounts and Interaction

1.1 Account Creation

To access Driftstack services, users must register and create an account. You hereby agree to provide accurate, current, and complete information during the registration process and undertake to update such information to maintain its accuracy, currency, and completeness.

1.2 User Interaction

Driftstack enables users to create and utilize development spaces, share work with team members, and engage in code reviews, pair programming, and user acceptance testing (UAT).

1.3 Subscriptions and Payment 

The services are billed based on the number of developer seats utilized. Payments are to be made online via credit card and are subject to the terms and conditions of the payment processing provider.

2. Data Handling and Privacy

2.1 Collection of Personal Information 

We collect personal information such as names and email addresses solely for the purposes of account authentication and product-related communications. This information shall not be shared with third parties, except as required by law or as outlined in our Privacy Policy.

2.2 Data Retention and Deletion

All user and company data is retained indefinitely, unless explicitly deleted by the user. Upon deletion, data will be preserved in backups for a period of thirty (30) days before being permanently erased.

3. Intellectual Property and Content Ownership

3.1 Service Ownership

Driftstack retains all intellectual property rights in the Service, with the exception of the content uploaded or provided by users.

3.2 User-Generated Content

Users retain intellectual property rights over the content they create within Driftstack, including but not limited to custom project templates.

4. Limitation of Liability

Driftstack shall not be liable for any interruptions, errors in service, or lack of user satisfaction. The service is provided “as is” without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

5. Jurisdiction and Governing Law

This Agreement and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles. The jurisdiction for any legal proceedings shall be Toronto, Canada.

6. Amendments and Termination

6.1 Amendments 

Driftstack reserves the right to unilaterally modify these Terms at any time. Users will be notified of such changes, which shall become effective upon posting or as otherwise specified by Driftstack.

6.2 Account Termination 

Driftstack may, at its sole discretion, modify, suspend, or terminate user accounts at any time without prior notice or refund.

7. Fair Use and Abuse Policy

Users are prohibited from misusing subscriptions, including but not limited to sharing subscriptions, using Driftstack spaces for non-development purposes, or reselling Driftstack spaces. Violation of this policy may result in suspension or termination of the user’s account.
